STUD SERVICE CONTRACT

Breeding Agreement

This document constitutes a binding agreement between The Olympus Standard Poodle, referred to as the "Stud Owner," and [Name of the Female Owner], identified as the "Female Owner," for the sale of semen from The Olympus Standard Poodle stud. Failure to meet the requirements below will void the contract.

This agreement, dated ____________, 20 _____, is between The Olympus Standard Poodle, the Stud Owner, and [Name of the Female Owner], the Female Owner. The purpose of this agreement is the purchase price of semen from The Olympus Standard Poodle stud.

Fees

The Female Owner agrees to pay the Stud Owner a non-refundable fee of ________ to reserve the desired mating date for the Female. The Female Owner agrees to pay the remaining balance of ____________ before the mating or shipment of semen.

Puppy(s) as Stud Fee (if applicable)

The Stud Owner is entitled to ______ puppy/puppies, to be selected by the Stud Owner and will be the ______ (first or second) after the Female Owner's pick. The stud fee puppy must be chosen within ______ weeks of birth. (If applicable)

Semen Collection

The Stud Owner agrees to provide up to two semen collections and shipments for non-local breedings. ______________________________________________ will handle collecting and shipping all semen. The Female Owner is responsible for all expenses associated with the collection and shipment of semen. Both the Stud Owner and the Female Owner agree that the semen will be used for the following procedures.

a. Fresh Semen via Artificial Insemination (AI) ______

b. Chilled Semen via Artificial Insemination or Transcervical Insemination (TI) ______

c. Frozen Semen via Transcervical Insemination (TI) or Surgical Implantation (SI) ______

Both the Stud Owner and the Female Owner agree that any AI, TI, or SI must be performed by a licensed veterinarian or breeder.

Additional Semen Shipment

The Stud Owner does not guarantee the birth of puppies from the breeding. The Stud Owner agrees to collect and send an additional semen collection for the same Female from the same Stud if there are fewer than two puppies resulting from the mating in the next heat cycle of the Female. Additional charges for collection and shipment will be the responsibility of the Female Owner. The Female Owner must provide proof via email to the.olympus.standardpoodle@gmail.com from a licensed veterinarian that (a) the mating was unsuccessful, or (b) the litter size was not guaranteed by the Stud Owner.

Vaccinations and Exams

The Female Owner agrees to take full responsibility for ensuring that all offspring resulting from the breeding are treated for parasites and receive at least one round of puppy vaccines and at least one puppy exam performed by a licensed veterinarian before the puppies are sent to their new homes.

The Female

The Female Owner declares, warrants, and agrees to the following:

a. The Female is healthy, has a solid and stable temperament, is of breeding quality, is free from diseases and parasites, and is up-to-date on all vaccines. The Female Owner must email the Stud Owner the proof of the Female's vaccination history before the Stud Owner accepts a breeding service appointment.

b. The Female has not been recently exposed to any stud before breeding.

c. The Female has a negative Brucella test conducted within the last 3 months before breeding. The test must be emailed to the Stud Owner before accepting a breeding service appointment.

Stud Owner's Right of Rejection

The Stud Owner has the right to cancel any shipment if the Female Owner does not provide all required documentation. The Stud Owner also has the right to cancel the contract if it is discovered that the Female Owner is guilty of document forgery, has been dishonest in the application process, or has been disrespectful to the Stud Owner. If any of these conditions are met, the contract will be considered void, and the Female Owner will not receive a refund of their reservation fee.

X-Ray to Confirm the Number of Puppies

The Female Owner agrees to perform an X-ray on the Female between days 55 and 58 of the gestation cycle to confirm the number of puppies. The X-ray image must be emailed to the Stud Owner as part of the prerequisites for the breeding service appointment.

Notification

The Female Owner must email the Stud Owner when the pregnancy is confirmed, when the puppies are born, and how many puppies were born within a week of each event.

Accidental Breeding

The Female Owner agrees to keep the Female properly confined after mating for the duration of her heat cycle to ensure no accidental breeding. If an accidental mating occurs, the Female Owner agrees to notify the Stud Owner within 12 hours. Additionally, the Female Owner agrees to conduct DNA tests on each puppy from such an accidental mating to establish parentage before selling, giving away, or otherwise placing any puppy.

Stud Owner's Obligations

The Stud Owner declares, warrants, and agrees to the following:

a. The Stud is healthy, has a solid and stable temperament, is of breeding quality, is free from diseases and parasites, and is up-to-date on all vaccines.

b. The Stud has a negative Brucella test conducted within the last 6 months before collection.

c. The Stud has at least approved preliminary OFA for hips and elbows, and/or low average PennHIP scores, and a complete genetic panel.

Litter Advertisement

The Female Owner agrees to list/credit the Stud Owner (The Olympus Standard Poodle) in each litter advertisement, announcement, or update. Refusal to list/credit the Stud Owner The Olympus Standard Poodle

Puppy Placement

a. The Female Owner agrees not to transfer ownership, in any way, of any puppy resulting from the breeding to any person or organization whose intention is to resell, trade, or give away the puppy or use it in laboratory experiments (including, among others, pet stores, pet store owners, shelters, or research laboratories).

b. The Female Owner agrees to email the Stud Owner the list of puppies, new families, and states to which the puppies were sent before the puppies reach 10 weeks of age.

c. The Female Owner agrees to reclaim any puppy resulting from the breeding if the puppy's families can no longer keep the puppy for its entire life.

Dispute Confidentiality

The Female Owner and the Stud Owner agree that, in the event of a dispute between them, neither will publish nor communicate the existence or content of such dispute in any media or forum, including social media, provided that this provision does not prevent either party from initiating legal action or participating in confidential mediation.

Applicable Law

This Agreement and all matters arising or related to this Agreement shall be governed and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions.
